These Terms & Conditions govern the use of the facilities, memberships, services and bookings provided by Elevisíon Academy B.V.

Hereinafter referred to as “Elevisíon”, “we”, “our” or “us”.
2. Definitions
In these Terms & Conditions the following definitions apply:
- Member
- Any individual or company that has entered into a membership agreement with Elevisíon.
- Visitor
- Any person entering the premises of Elevisíon without a membership.
- Workspace
- Any coworking desk, private office, consulting suite, meeting room, studio or other facility provided by Elevisíon.
- Membership
- Any subscription or service agreement granting access to Elevisíon facilities.
- Booking
- A reservation for a space, service, studio, event venue or meeting room.
- Agreement
- These Terms & Conditions together with any membership agreement, booking confirmation or other policies.
3. Nature of the Agreement
- Elevisíon provides coworking and workspace services and does not provide a lease of real estate.
- Memberships grant a license to use the facilities, not exclusive property rights.
- Elevisíon reserves the right to relocate members within the premises when reasonably necessary.
4. Membership Eligibility
Membership is available to:
- Entrepreneurs
- Freelancers
- Professionals
- Companies
- Coaches, trainers, consultants and creatives
Elevisíon reserves the right to refuse membership applications at its sole discretion.
5. Membership Types
Elevisíon offers several membership categories including but not limited to:
- Cowork memberships
- Dedicated desks
- Private offices
- Consulting suites
- Gym memberships
- Studio access memberships
- Event bookings
- Day passes and Hour Cards
Details regarding pricing, access rights and services are specified on the website or in individual agreements.
6. Access to the Facilities
Members may access the facilities only within the agreed membership terms. Access may include:
- Cowork areas
- Private offices
- Consulting rooms
- Meeting rooms
- Gym facilities
- Vision Atelier studio
- Event spaces
Elevisíon may temporarily restrict access due to maintenance, events, technical issues or safety concerns.
7. Guests
Members may invite guests subject to the following conditions:
- Guests must be registered at reception if required
- Guests must comply with house rules and membership rules
- Members remain responsible for their guests
Elevisíon may limit guest access at its discretion.
8. Bookings
- Spaces such as meeting rooms, studios, consulting suites and event venues may require advance booking.
- Bookings are confirmed only after payment or written confirmation.
- Elevisíon reserves the right to refuse bookings.
9. Cancellation Policy
Cancellation policies vary per service.
Vision Atelier Studio
- More than 72 hours before booking → full refund
- Less than 72 hours → no refund
- Rescheduling allowed once free of charge if requested at least 72 hours before the booking. Subsequent changes may incur a rescheduling fee.
Event Venue
- More than 14 days before event → full refund
- Less than 14 days → 50% fee
- Less than 72 hours → 100% fee
Day Passes and Short-Term Bookings
- More than 24 hours notice → full refund
- Less than 24 hours → no refund
Memberships
Early Termination
If a membership is terminated before the end of the agreed contract term, the member is required to pay a reasonable early termination fee. This fee amounts to 30% of the remaining contract period, with a minimum of one month of membership fees.
Example: If a 12-month contract is terminated after 4 months, 8 months remain. The termination fee will then be 30% of the remaining period.
Renewal in Case of Late Cancellation
If the membership is not cancelled in writing before the end of the agreed contract term, the agreement will automatically continue for an indefinite period. From that moment onward, the membership may be terminated on a monthly basis with a notice period of one month.
Daypart Membership — Use and Cancellation
- Unused Daypart: A reserved daypart is considered a confirmed booking. If the member does not make use of the reserved daypart, the booking will expire and no refund or rescheduling to another date will be granted.
- Cancellation by Elevisíon: If Elevisíon is required to cancel a reserved daypart, the daypart will be rescheduled free of charge to another available date in consultation with the member.
- Early Termination of Membership: A notice period of one month applies. If the agreement includes a minimum contract duration, an additional termination fee equal to two monthly membership payments will apply.
10. Payments
Membership fees and bookings must be paid monthly, per booking, or as otherwise agreed.
Accepted payment methods include bank transfer, card payments, automated debit and online payment providers.
Late payments may result in suspension of access, cancellation of services or administrative fees.
11. Termination of Membership
Members may terminate their membership according to the agreed notice period.
Elevisíon reserves the right to terminate memberships immediately in cases including but not limited to:
- Breach of these terms
- Abusive behavior
- Non-payment
- Illegal activity
- Damage to property
- Behavior compromising safety or community wellbeing
12. Code of Conduct
Elevisíon is committed to maintaining a respectful, inclusive and professional environment. Members and visitors must not engage in:
- Harassment
- Discrimination
- Intimidation
- Illegal activities
- Damage to property
- Disruptive behaviour
Violations may result in removal from the premises.
13. Use of Facilities
Members agree to:
- Treat all used facilities with care
- Keep shared areas clean
- Respect other members
- Comply with safety regulations
Equipment and spaces must be used according to their intended purpose.
14. Gym Use
- Use of the gym facilities is entirely at the user’s own risk.
- Members confirm that they are medically fit for physical activity.
- Elevisíon is not responsible for injuries resulting from gym use.
15. Liability
To the maximum extent permitted by law, Elevisíon shall not be liable for:
- Loss of personal belongings
- Theft
- Damage to equipment brought by members
- Indirect or consequential damages
Members are responsible for any damages they cause to the premises or equipment.
16. Insurance
Members are responsible for arranging their own insurance coverage where applicable. Professionals operating within Elevisíon (such as coaches, therapists or personal trainers) must maintain appropriate liability insurance. Elevisíon is not responsible for injuries during these sessions.
17. CCTV and Security
CCTV cameras may be installed throughout the premises for security purposes. Recordings are processed in accordance with privacy legislation.
18. Intellectual Property
All intellectual property rights relating to Elevisíon branding, design, content and concepts remain the property of Elevisíon. No part of the brand, concept or materials may be reproduced without permission.
19. Photography & Media
Elevisíon may occasionally record photographs or video within the premises for marketing or promotional purposes. Visitors may notify staff if they prefer not to appear in such materials.
20. Internet Use
Elevisíon provides internet access as a service. We do not guarantee uninterrupted connectivity. Users may not engage in illegal activities via the network.
21. Force Majeure
Elevisíon shall not be liable for failure to perform obligations where such failure results from circumstances beyond reasonable control including:
- Natural disasters
- Pandemics
- Governmental restrictions
- Infrastructure failures
22. Changes to the Terms
Elevisíon reserves the right to amend these Terms & Conditions. Members will be notified of material changes. Continued use of the services constitutes acceptance of the updated terms.
23. Additional Provisions
Independent Status of Entrepreneurs / Personal Trainers
Personal Trainers operating within Elevisíon do so as independent entrepreneurs. There is no employment relationship between Elevisíon and their coaches, trainers or entrepreneurs.
Protection of Member Base
Personal Trainers acknowledge that members and clients training at Elevisíon form part of the Elevisíon member base. Trainers are not permitted, during the collaboration and for 12 months after termination, to actively solicit Elevisíon members to train outside Elevisíon. This includes:
- Recruiting members for training at other locations
- Offering alternative training locations outside Elevisíon
- Encouraging members to cancel their Elevisíon membership
Medical Disclaimer
Members and clients coach and train at their own responsibility and must inform trainers of any medical conditions or limitations prior to training.
Community Clause
Elevisíon reserves the right to terminate memberships or collaborations if behaviour does not align with the values, safety and standards of the Elevisíon community.
24. Indemnification
Members, visitors, Personal Trainers, event organizers and any other users of the facilities agree to indemnify, defend and hold harmless Elevisíon, its directors, employees, contractors and affiliates from and against any claims, damages, liabilities, costs or expenses (including reasonable legal fees) arising out of or related to:
- The use of the facilities by the member or visitor
- Services provided by Personal Trainers, coaches or other professionals
- Violation of these Terms & Conditions
- Negligent or unlawful conduct of the user
This indemnification obligation applies to claims brought by third parties, including but not limited to other members, guests or clients.
25. Commercial Filming & Content Production
Commercial filming, photography or content production within the facilities of Elevisíon is only permitted with prior written approval from Elevisíon. Elevisíon reserves the right to:
- Approve or deny filming requests
- Determine appropriate filming areas
- Impose additional fees for commercial productions
Members and visitors may not use the facilities for commercial media production, advertising campaigns or large-scale content production without explicit permission.
26. Events & Alcohol Policy
Event organizers are fully responsible for the conduct, safety and behaviour of their guests. The organizer must ensure compliance with all applicable laws and safety regulations. Elevisíon shall not be held responsible for incidents, injuries or damages occurring during privately organized events, including incidents related to alcohol consumption or guest behaviour. Elevisíon reserves the right to immediately terminate events that compromise safety, security or the wellbeing of members or visitors.
27. Business Registration
Members may not use the address of Elevisíon Academy B.V. as their official business registration address without prior written approval from Elevisíon. Unauthorized use of the Elevisíon address for company registration, correspondence or legal documentation may result in immediate termination of the membership or service agreement.
28. Network Usage & IT Security
Elevisíon provides internet access as a service to members and visitors. Users agree not to:
- Engage in illegal online activities
- Download or distribute illegal materials
- Attempt to access restricted networks or systems
- Interfere with the network security or functionality
Elevisíon reserves the right to restrict or terminate internet access in cases of misuse.
29. Lost Property
Elevisíon is not responsible for lost, stolen or misplaced personal belongings within the premises. Items found within the facilities may be stored for a limited period at the discretion of Elevisíon. Unclaimed items may be disposed of after a reasonable storage period.
30. Suspension of Access
Elevisíon reserves the right to temporarily suspend access to the facilities in cases including but not limited to:
- Violation of house rules or the Terms & Conditions
- Payment delays or outstanding balances
- Safety concerns
- Disruptive behaviour
During the suspension period, the member or visitor may be denied access to the premises without entitlement to compensation.
31. Safety & Emergency Procedures
Members and visitors must comply with all safety instructions, emergency procedures and evacuation guidelines issued by Elevisíon staff. Failure to follow safety procedures may result in removal from the premises or termination of membership. Elevisíon shall not be held liable for damages resulting from failure to follow safety instructions.
32. No Employment Relationship
Nothing in these Terms & Conditions shall be interpreted as creating an employment relationship, a joint venture, or an agency relationship between Elevisíon and any member, Personal Trainer, entrepreneur, coach or visitor.
All personal trainers, coaches, and professionals operating within Elevisíon act exclusively as independent entrepreneurs. They operate their own businesses and remain entirely responsible for the services they provide, as well as for all agreements, obligations, and relationships with their clients. The collaboration with Elevisíon constitutes solely a short-term or long-term assignment agreement. Under no circumstances shall Elevisíon be considered responsible or liable for any services rendered, claims, disputes, damages, or obligations arising between these independent professionals and their clients.
33. Reputation & Brand Protection
Members, trainers and visitors may not use the Elevisíon name, brand, facilities or community in any way that could reasonably harm the reputation, integrity or commercial interests of Elevisíon. Elevisíon reserves the right to terminate memberships, collaborations or access rights if behaviour or conduct damages or risks damaging the reputation or community environment of Elevisíon.
34. Governing Law
These Terms & Conditions are governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam.
